Hygiene and Safety Exceptions

Under Section 312g (2) No. 3 BGB and Article 16(e) Directive 2011/83/EU, the right of withdrawal does not apply to sealed goods unsuitable for return for reasons of health protection or hygiene, once the seal of the box has been broken.

This includes, but is not limited to:

• Underwear and base layers once opened or tried on

• Sealed bottles and containers once opened

• Motorcycle helmets once visor film has been removed or the helmet has been worn or tried

As long as the seal is intact and no fitting has taken place, the withdrawal right remains applicable.
